Modifying Child Custody and Visitation (Parenting Plans)
In the state of Washington, a party seeking to obtain a change of custody must show that there has been a substantial change of circumstances. To prevail in a change of custody proceeding, you must obtain the agreement of the custodial parent or you must demonstrate to a court that the emotional or physical well-being of the minor child is jeopardized.
By contrast, it is much simpler for a parent to establish grounds for a modification of the existing visitation schedule. A job change or other life change of the parent or child may warrant a modification of the visitation schedule.
Modification of Child Support
A child support order may be modified of upon a showing that there has been a substantial change of circumstances. A substantial change can be demonstrated in a number of contexts, including a substantial change in salary of either party, a job layoff, or other factors that affect the financial well-being of the parties.
